RESOLUTION

NO. 204 OF 2026

A RESOLUTION OF THE CITY OF VENTNOR, COUNTY OF ATLANTIC, STATE OF NEW JERSEY APPOINTING STEVEN SECARE ESQ. AS HEARING OFFICER  NOT TO EXCEED $15,000

WHEREAS, the City of Ventnor is in need of a Hearing Officer; and

WHEREAS, Steven Secare Esq.. has offered to perform the services required as Hearing Officer for a fee $175.00 per hour for a maximum amount of $15,000.00; and

WHEREAS, a certificate of Availability of Funds issued by the Municipal Chief Financial Officer states that there are available and sufficient legally appropriated funds in 6-01-20-155-020-027 (Legal Services) for purpose of this contract. A copy of the Chief Financial Officer’s certification(s) shall be filled with the shall be filled with the City Clerk with the original of this resolution; and

WHEREAS, the Ventnor City Board of Commissioners is desirous of reappointing Steven Secare, Esq. . to serve as Hearing Officer; and

WHEREAS, the Local Public Contracts Law (NJSA 40A:5-11 et seq.) requires that the Resolution authorizing the award of contracts for “Professional Services” without competitive bids must be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Ventnor City authorize that the Contract is awarded without competitive bidding as a “Professional Service” under the provisions of the Local Public Contracts Law because the law permits the waiving of competitive bids under NJSA 40A:5-11.

BE IT FURTHER RESOLVED that STEVEN SECARE, ESQ. is herein and hereby appointed Hearing Officer to handle all normal legal services as determined and authorized by the City of Ventnor for the City of Ventnor City for a one-year term effective July 9^th 2026..

BE IT FURTHER RESOLVED that a notice of this appointment be published at least once on the City of Ventnor Website pursuant to the requirements.
